Laws and regulations relating to the environmental consequences of generating, storing, treatment and disposal of products and waste materials integral to modern society have evolved rapidly, in keeping with rapid changes in industry, technology and government. Our attorneys have been at the forefront of these developments, in the legislatures, before regulatory agencies and in the courtroom.

We are experienced in guiding clients though the thickets of statutory and regulatory requirements including those arising under federal law such as CERCLA/SARA, the Resources Conservation and Recovery Act ("RCRA"), the Clean Water Act ("CWA"), Toxic Substances Control Act ("TSCA"), Emergency Planning and Community Right to Know Act ("EPCRA"), Safe Drinking Water Act ("SDWA"), Clean Air Act ("CAA"), as well as state and local law such as New York's Navigation Law and "brownfields" regulations. We have frequently written and lectured on many aspects of these areas of law.

Our experience includes defense of companies or individuals at waste or industrial sites throughout the United States. These activities have involved working with regulators, defending clients in regulatory proceedings and appearing in court to challenge regulations or in connection with cost-recovery claims. We have handled pollution situations from on-site investigation, through spill reporting to final cleanup, providing assistance and counseling with respect to federal, state and local requirements regarding release notification, site access, remedial investigation, cleanup plan selection and implementation of remedial measures.

We have also represented clients in many of the largest environmental-insurance cost recovery actions filed in the United States, and have defended responsible parties in state and federal court actions by governments or other responsible parties seeking recovery of remedial costs.

Equally important is our compliance practice. We confidentially assist our clients in conducting environmental audits or "due diligence" reviews, either in connection with ongoing operations or in anticipation of real estate transfers, corporate acquisitions or financing. Working with a network of experienced technical experts including hydrogeologists, forensic geochemists, licensed professional engineers and others, we are able to marshal the technical expertise necessary to understand complex technical issues and, where the client's interests are best served in doing so, to present those issues to counter-parties, regulators judges or juries.
